본 논문은 북한의 핵위협이 고도화된 상황에서 한국이 자체적으로 방어할 수 있는 방법은 예상자위권을 발동하는 수밖에 없다는 문제의식에 근거하여 그의 적용 가능성을 탐색해보기 위한 목적으로 작성되었다. 이를 위하여 ‘차단 자위권’ 개념과 그의 현실적 적용방향을 검토하였고, 북핵위협 수준, 미국의 확장억제 신뢰도, 한국의 방어태세를 비교한 후 차단타격의 도입 필요성을 제시하였다. 그리고 절박성, 정당성, 위험성, 실행 가능성, 국내여론, 지도자의 의지 등 6가지 요소를 통하여 차단타격에 관한 현 실태를 분석하였다. 분석의 결과 북한은 고체연료 엔진을 사용하는 핵미사일을 개발 및 확대하고 있고, 미국의 확장억제 이행을 역(逆)으로 억제하고자 노력하고 있기 때문에 북한이 핵미사일 공격으로 위협할 경우 한국이 차단타격을 실시해야 할 당위성이 높다고 평가하였다. 그러나 6가지 고려요소를 고려하여 차단타격의 실행 가능성을 평가해본 결과 절박성과 정당성 이외에는 차단타격을 결정할 가능성이 작은 것으로 드러났다. 따라서 한국은 차단타격에 관한 논의를 적극화하는 것은 물론이고, 그의 위험성, 부정적인 국내여론, 핵억제와 방어에 대한 지도자의 안목을 증대시키고자 노력할 필요가 있다. 한국은 필요시 차단타격을 실시할 수 있는 자체적인 시행방안을 발전시켜 나가되, 적절한 범위 내에서 미국과의 협력도 추진할 필요가 있다.

This paper is written to discuss on how to apply the right of anticipatory self-defense for South Korea, when North Korea threatens to attack South Korea with its nuclear weapons. For this purpose, it introduces the concept of anticipatory self-defense including an interceptive strike option, which seems to be indispensable for South Korea in order to defend its people from a possible North Korean nuclear missile attack especially when the U.S. becomes reluctant to provide its promised extended deterrence. It uses six factors including inevitability, legality, risk and others to assess the relevance of the interceptive strike for South Korea. This paper found that South Korea should consider the interceptive strike option seriously, if North Korea threatened to use nuclear weapons to it, especially because North Korea could launch its nuclear missiles in five minutes by using solid fuel missiles. South Korea should put dominant emphasis on the inevitability of the interceptive strike rather than balanced consideration of all six factors. South Korean government should identify and fix the related problems regarding the interceptive strike option, make its own plans to implement it and to seek for cooperation with the U.S. for it.
