이 연구는 헌법상 문화국가원리를 실현하고 문화재보호법의 복잡화를 극복하며, 유네스코 협약에 따른 세계유산 제도에 대응하기 위한 방법으로 국가유산 개념 정립을 시도하였다. 이를 위하여 국가유산기본법 제정의 필요성을 헌법, 국제법, 문화재보호법, 문화재행정 현실의 차원에서 제기하고, 국가유산기본법이 제정될 경우 포함시켜야 할 과제와 내용을 구체적으로 분석하고자 하였다. 아울러 국가유산기본법의 하위 개별법제 체계를 어떻게 구성하는 것이 바람직한지와 관련하여 국가유산 행정의 원리와 분류체계를 고려한 법체계를 제안하고자 하였다. 연구결과 국가유산 개념의 정립과 국가유산기본법 제정이 필요한 것은 헌법의 문화국가원리 실현 이외에도 국제법상 세계유산제도와 정합성 제고, 문화재보호법의 한계 극복, 방대해지고 복잡해진 문화재행정과 조직의 효율성 제고를 위해 필요하다고 보았다. 가칭 국가유산기본법은 현행 문화재보호법을 대신하여 국가유산정책을 새로운 방향으로 전환하기 위하여 신법으로 제정하고, 하위 법체계가 국가유산 유형별 법체계, 국가유산 부속 법률, 국가유산 관계 법률, 국가유산 지원 법률로 성격을 갖도록 구체적으로 제안하였다. 새로운 국가유산 법체계에서는 국가유산 정책의 통일성, 체계성, 효율성이 제고되고, 공동체 구성원의 문화유산에 대한 향유 보장, 국가유산을 통한 국격 제고가 기대된다.

This research attempted to establish the concept of national heritage as a way to realize the Constitutional Principle of the Cultural State, overcome the complexity of the Cultural Heritage Protection Act, and respond to the World Heritage System under the UNESCO Convention. To this end, the necessity of enacting the Framework Act on National Heritage was raised in terms of the Constitution, the International Law, the Cultural Properties Protection Act and the reality of the Cultural Heritage Administration. And when the Framework Act on National Heritage was enacted, the tasks and contents to be included were analyzed in detail. Further, a legal system considering the nature, functions and procedures of national heritage was proposed by reviewing how it was desirable to organize the lower legal system of a Framework Act on National Heritage. According to the research, it is necessary to establish the concept of national heritage and enact a Framework Act on National Heritage, as well as to enhance the world heritage system and consistency, overcome limitations of the Cultural Heritage Protection Act, and enhance the efficiency of cultural heritage administration and organization that have become vast and complicated. As a sub-law of Framework Act on National Heritage, the legal system for each type of national heritage and various laws related to national heritage were specifically proposed. In the new national heritage legal system, the unity, systemicity and efficiency of national heritage policies are expected to increase, guarantee the enjoyment of cultural heritage of community members, and raise national prestige through national heritage.
