North Korea's dispatch of overseas workers is a violation of sanctions against North Korea, but it is still in progress in some countries, and the acquisition of foreign currency is being invested in the luxury of high-ranking North Korean authorities and the development of weapons of mass destruction (WMD), making it difficult for North Koreans to live and raising tensions on the Korean Peninsula and the international community. Amid the recent turmoil in the international situation, such as the Russia-Ukraine war, North Korea's issues related to overseas dispatched workers are decreasing in the process of setting agendas within the international community. As the sanctions against North Korea are expanded to comprehensive sanctions including two aspects of the human rights regime and the security regime, the effectiveness of sanctions on North Korea's overseas dispatched workers is decreasing due to a number of considerations. From the perspective of international law, this paper considers ways to reduce the structural gap between the legitimacy and effectiveness of sanctions on the illegality of North Korea's dispatch of overseas workers, and proposes strengthening the UN sanctions and implementation mechanism, ensuring transparency and participation in procedures, expanding representation in the international community, and establishing a performance evaluation system.
