[학술논문] 북한 도발 시 “단호한 대응”과 “확전 방지” 조화 방안: 자위권과 교전규칙을 중심으로
2010년 11월 23일 연평도 포격 이후 “단호하게 대응하되 확전을 방지하라”라는 대통령의 상충된 지침과, 교전규칙에 집착하여 공군기로 적 포진지를 사격하지 못하였다는 군의 설명이 국민들의 호된 질책을 받았다. 그러나 이러한 지침이나 설명은 오히려 타당한 것으로 앞으로의 도발 대응에도 적용되어야 한다. 이러한 측면에서 자위권과 교전규칙의 개념을 정리한 후, 천안함 폭침과 연평도 포격 시 한국군이 실제적으로 적용했던 사례를 분석하였고, 특히 북한의 핵무기 사용, 수도권에 대한 제한적 공격, 서해 5개 도서에 대한 상륙공격, 주요 도시에 대한 미사일 공격 등의 상황을 예상하여 “단호한 대응”과 “확전 방지”를 어떻게 조화시킬 것인지를 분석하였다.
