No one knows when unification between the two Koreas will occur. But this paper argues that when it happens, undertaking a fair and transparent process of transitional justice will be the key element that will help achieve successful peace-building and reconciliation in unified Korea. Given the complexity of the legal, social, political, and economic issues involved, this paper maintains that the future of peace, human rights, and ultimately, reconciliation in post-unification Korea is directly linked to how people in this society understand and accommodate the past in the present. A multi-faceted analytical approach is applied to outline the aspects of transitional justice that could apply in the Korean context. While primarily based on a legal framework, the analysis seeks to incorporate an interdisciplinary approach, opening up possibilities for collaboration from several different vantage points by examining the problem within the parameters of a transitional justice lens.
