[국내] 未承認國家와 베른條約 - 北․日間 <em>著作物</em> 保護義務論爭(東京地法 2007年 12月 14日判決)을 中心으로 -

... 통해 북한에 대한 일본의 입장과 정책들을 검토하고자 한다. 본 판결은 직접적으로는 북․일간의 문제이지만 향후 남북한 관계와 한․일간에도 영향을 줄 수 있다는 점에서 매우 중요하다. 최근 우리나라에서도 북한 저작권과 관련한 소송의 제기가 늘어나고 있다. 일본과는 달리 우리나라는 북한의 <em>저작물</em>에 대해 그 권리를 인정하고 있다. 북한의 <em>저작물</em> 보호와 관련하여 우리나라는 판례를 통해 북한의 <em>저작물</em>이 남한에서 보호된다는 점을 명백히 하고 있다. 그러나 그를 인정한 논리는 매우 다르다. 즉 베른조약이나 저작권이 아니라 우리헌법 제 3조의 영토조항을 근거로 북한에도 우리헌법의 효력이 있다는 점을 전제로 하여 저작권을 인정하는 판결을 내리고 있다본 연구에서는 우리나라와 달리 일본이 북한에 대해서 저작권의 보호의무가 없다는...
