이 논문은 평화교섭법이라는 대안적인 법･정치적 관점을 활용해 남북합의서에서 자결 규범의 전개 양상과 의의를 논의한다. 한반도에서 통일국가 형성 또는 통치체제의 재구성에 관해서 민족의 주도성이 중요한 것에 대해서 충분한 공감대가 있는데, 일부 연구자들은 이 법적 근거로서 민족자결권을 현행 한국 헌법 및 향후의 평화협정에 명기하는 것을 구체적으로 제안하고 있다. 그런데, 탈식민지 시대인 현대 국제법에서는 민족자결권의 의미나 행사는 매우 논쟁적 문제이기도 하다. 이 논문은 평화교섭법에서 말하는 혼합적 자결 규범이라는 대안적인 관점에서 지금까지 남북합의의 논의 내용을 살피고, 그 의의나 개헌의 필요성 등을 검토한다. 결론으로서 다음과 같이 주장한다. 1) 한반도 남북합의에서도 평화교섭법에서 말하는 혼합적 자결 규범의 대동과 전개를 충분히 확인할 수 있다. 2) 혼합적 자결 규범이란 상징적 국가 재규정, 권력 분산, 권력 전이 그리고 주권 개념의 재구성을 수반하는 다각적 이슈이다. 즉, 이러한 맥락에서 보면 민족자결권을 헌법에 명기하는 것은 유익할 수 있으나, 법적으로 꼭 필요한 것이라고 하기보다는 정치적 교섭과 관련되는 중요한 전략적 이슈이다. 3) 평화교섭법 관점을 활용하면 향후의 평화협정이나 관계 재구축에 관해서 기존의 형식적인 비교연구를 넘어, 세계의 수많은 평화합의 데이터를 활용한 체계적이고 전략적인 연구가 가능하다. 이에 따라 자결 규범이나 민족 주도성에 관한 보다 효과적인 사고방식이나 정책 수립의 길을 열 수 있을 것이다.
This paper discusses the development and significance of the self-determination norm in the peace agreements over Korean conflict from a view of the lex pacificatoria, or a law of peacemakers. While there is no dispute that national/ethnic initiative is important for the formation of a unified state or reconfiguration of governance on the Korean Peninsula, some scholars have further proposed that the “right to self-determination” should be articulated in the current South Korea’s constitution and future peace agreements. However, the meaning and exercise of this right is a highly contentious issue in contemporary international law in the era of post-colonization. This paper reviews the discussions on the paece agreements to date from an alternative perspective of the “hybrid self-determination” which is one of core ideas in the lex pacificatoria, and examines its significance and the necessity for constitutional amendment. In conclusion, this paper argues following three points: 1) the formation and development of the hybrid self-determination as referred to in the lex pacificatoria can be substantially confirmed in the case of Korean peace agreements; 2) The hybrid self-determination is a multifaceted issue that involves redefinition of state, disaggregation of power, dislocation of power, and reconfiguration of the concept of state sovereignty. In this context, constitutional amendment of the right to self-determination will be influential, but not necessarily, as a legal step toward unification. National/ethnic self-determination can be interpreted as a long-term, strategic issue related to political negotiations. 3) The pax pacificatoria and the large number of peace agreement data from around the world will allow for more systematic and strategic research, beyond the traditional restrictive comparative studies with regard to future peace agreements and structural rebuilding of Korean peninsula. This will also open up a broader perspective on self-determination norms and national/ethnic initiative for unification.
