북한에서 급변사태로 현 정권이 무너진다면 한국 중심으로 한반도 전체의 통일이 이루어질까? 대한민국 헌법 제3조 영토조항에도 불구하고 한반도에 대한 복잡한 국제 정세와 북한의 국제법상 지위를 고려하면 근본적인 의문이 제기된다. 이 논문은 이러한 문제의식에서 출발하였다.
한반도의 온전한 통일은 당연히 이루어지는 것이 아니며, 남북한의 긴밀한 협력과 단계적인 통일 전략이 필요하다. 특히, 통일에 실질적으로 기여할 수 있는 경제통합 전략이 필요한데, 남북한의 현격한 경제 구조의 차이와 급진적 통일에 따른 과도한 통일비용을 지출한 통일독일의 선례를 고려하면 단시일 내 완전한 통일을 이루기는 어려울 것이므로 평화체제를 유지하면서 단계적으로 경제통합을 추진하는 것이 바람직할 것이다.
따라서 이 논문에서는 남북한의 경제통합을 3단계로 나누어서 단계마다 고려할 수 있는 국제통상법적 쟁점을 제시하였다. 앞으로 남북한 경제교류가 확대될 경우 국제적으로 제기될 수 있는 문제와 해결방안을 국제통상법적 측면에서 살펴보고 준비하자는 의도이다. 이를 통하여 남북한의 경제통합과 국제통상법과의 정합성을 제고하여 남북한 통일을 대비하는 데 기여하고자 하였다.
남북한 경제통합 3단계는 남북한 경제를 서로 다른 시장경제체제와 중앙계획경제체제로 유지할 것인가(2경제체제) 아니면 북한경제를 시장경제체제로 전환할 것인가(1경제체제)의 선택과 남북한 경제를 단일경제권으로 통합(1경제)할 것인가 아니면 상당 기간 지역적으로 분리하여 운영(2경제)할 것인가에 대한 선택의 조합으로 구성하였다.
경제통합 1단계(2경제체제 2경제)에서는 남북한 무관세 교역의 최혜국대우의무 예외를 인정받는 방안과 개성공단과 같은 남북경제특구 생산제품의 원산지 문제에 대하여 고찰하였다. 그 전에 현재 남북한 경제협력사업에 큰 변수가 되고 있는 국제사회의 대북제재를 살펴보고, 특히 UN 대북제재와 남북경협사업의 양립 가능성을 검토하였다.
경제통합 2단계(1경제체제 2경제)에서는 북한의 시장경제체제 전환에 따른 국제통상법적 쟁점으로 북한의 WTO 가입과 남북한의 지역무역협정 체결에 대하여 고찰하였다. 먼저 북한의 WTO 가입은 세계 각국의 투자와 교역 증가로 경제성장의 혜택을 누릴 수 있지만, 자국 시장을 개방하고 WTO 규범을 준수하여야 할 의무도 함께 부담하게 된다. 이때 북한이 고려하여야 할 법적 쟁점으로 개도국 및 최빈개도국 인정 여부와 시장경제지위 인정 여부, 미국과 ‘항구적 정상무역관계’ 구축 등을 살펴보았다.
남북한의 지역무역협정 체결은 남북교역을 최혜국대우의 예외로 인정받을 수 있는 근본적인 방안이라는 점과 남북한 경제통합의 실질적인 수단으로써 의미가 있다. 그러나 GATT 제24조 제5항에서는 WTO 회원국 간 지역무역협정만을 인정하고 있으므로 먼저 북한의 WTO 비회원국 지위 문제를 살펴보았다. 또한, 남북한 지역무역협정 체결의 실체적 요건으로서 대내적 요건을 충족하여야 하는데, GATT 제24조 제8항에서 지역무역협정을 체결하는 회원국 간에 ‘실질적으로 모든 무역’(substantially all the trade)에 관하여 관세 및 그 밖에 제한적인 상거래 규정이 철폐되어야 한다는 대내적 요건을 살펴보았다. 마찬가지로 위 2가지 쟁점을 GATS 제5조를 통하여 함께 살펴보았다.
경제통합 3단계(1경제체제 1경제)에서는 남북한의 경제를 단일경제권으로 통합하는 것일 뿐 아니라 정치적인 통일도 의미하므로 통일독일과 같이 통일한국이 되는 상황이다. 3단계가 되면 1, 2단계에서 논의하였던 국제통상법적 쟁점들은 자연스럽게 해결될 것이며, 3단계에서 남은 법적 쟁점은 한국과 북한이 그동안 체결한 경제관련 조약을 어떻게 처리하여야 할지의 문제이다. 그런데 남북한 통일을 흡수병합으로 볼 것인가, 합병을 통한 신국가의 형성으로 볼 것인가, 또는 국가연합으로 볼 것인가에 따라 조약의 승계 방식이 달라질 수 있으므로 이 3가지 통일방식 유형에 따라 기존 남북한이 체결한 경제관련 조약의 승계 문제를 고찰하였다.
A Study on International Trade Law Issues in the Unification of South and North Korea

If the current North Korean regime collapses due to a sudden change, will the entire Korean peninsula be unified under the supervision of the South Korean regime? Despite the territorial provisions of Article Ⅲ of the Constitution of the Republic of Korea, the complex international affairs on the Korean Peninsula and North Korea’s status under international law raised such a fundamental question. Hence this thesis started from awareness of the current status.
The unification of the Korean peninsula is not something to be achieved naturally. Thus close cooperation between the two Koreas and a step-by-step strategy for unification is needed. In particular, a strategy for economic integration that can actually contribute to unification is necessary. Considering the precedent of a unified Germany that expended excessive costs due to radical unification and the difference in the remarkable economic structure of the two Koreas, it will be difficult to achieve complete unification in a short period of time. It would be a desirable approach to promote economic integration in stages while maintaining a peaceful system.
Therefore, this paper attempts to present issues of international trade law that can be considered at each stage by dividing the economic integration between the two Koreas into three stages. The intention is to examine and prepare international trade law issues and solutions that may arise internationally in the future if economic exchanges between the two Koreas expand. Through this, it was intended to contribute to the preparation for the unification of the two Koreas by enhancing the coherence between the economic integration of the two Koreas and international trade law.
In the stage of economic integration between the two Koreas, the choice of whether to maintain the North and South Korean economy in a different market economy system and a centrally planned economy system (2 economic systems) or to immediately convert the North Korean economy into a market economy system (1 economic system) and the choice of whether to integrate their economies into a single economic zone (1 economy) or to operate them separately for a considerable period of time (2 economies) should be considered. The combination of these choices consisted of first, second, and third stages.
In the first phase of economic integration (2 economic systems, 2 economies), the method of being granted the exception to the MFN (Most Favored Nation) treatment obligation for tariff-free trade between the two Koreas and the issue of the origin of products produced in special inter-Korean economic zones such as the Kaesong Industrial Complex was considered. Before that, the international sanctions against North Korea, which are currently a huge variable in North-South economic cooperation projects, were reviewed, and in particular, the compatibility between the UN sanctions against North Korea and the Inter-Korean economic cooperation project was reviewed.
In the second stage of economic integration (1 economy system, 2 economies), North Korea becoming a member of the WTO and the conclusion of an RTA(Regional Trade Agreement) between South and North Korea were considered as issues of international trade law. First of all, North Korea joining the WTO can benefit from economic growth through increased investment and trade from countries around the world, however, it also bears the obligation to open its own markets and comply with WTO rules. At this time, the legal issues that North Korea should consider include whether to recognize developing and least-developed countries, whether to recognize the market economy status and to establish “permanent normal trade relations” with the United States. The signing of an RTA between the two Koreas has a meaning as a fundamental way to get Inter-Korean trade to be permitted as an exception to the MFN treatment obligation, and as a practical means of economic integration between the two Koreas. However, since Article XXIV of GATT only recognizes RTA between WTO members, the issue of North Korea’s status as a non-WTO member to conclude the RTA between the two Koreas was reviewed.
In addition, internal requirements must be satisfied as an actual requirement for the conclusion of the RTA between the two Koreas. Article XXIV:8 of GATT, so-called ‘internal requirements’ shows that upon the conclusion of an RTA liberalizing trade in goods, the parties must eliminate the duties and other restrictions of commerce with respect to “substantially all the trade” between themselves. Similarly, the above two issues were reviewed together in Article 5 of GATS.
In the third stage of economic integration (1 economy system, 1 economy), not only the economy of South and North Korea is integrated into a single economic zone, but it also means political unification, so it is a situation to become a unified Korea like unified Germany. In the third stage, the issues of international trade law that were considered in the first and second stages will be resolved naturally, and the legal issue remaining in the third stage is the question of how to deal with the economic treaties signed by South and North Korea. However, depending on whether the unification of the two Koreas is viewed as an annexation, the formation of a new state through a merger, or a confederation, the method of a succession of the treaty may vary. Depending on the type of unification methods, the issue of succession of existing economic treaties signed by South and North Korea was considered.
