[학술논문] 한반도 통일과 통일조항의 해석방향
본고는 헌법의 과제인 통일에 대하여 헌법이 규정하고 있는 통일조항에 대한 해석방향을 중심으로 전개하고 있다. 본고는 헌법상의 통일조항을 해석함에 있어서 통일을 지향하는 해석으로부터, 통일조항이 어떠한 의미를 가지며, 통일 및 통일과정에서 어떠한 영향을 미치는지, 통일국가에 대하여 어떠한 효과를 가지는지를 고찰하였다. 헌법상의 통일조항은 영토조항과 평화통일조항으로 크게 대별되는데, 우선 이들의 관계가 문제되고 있다. 본고에서는 이들에 관한 논의를 검토하고, 양자의 관계를 통일지향적인 해석을 통하여 해결하는 방안을 제시하였다. 즉 본고는 영토조항과 통일조항의 관계를 통일의 달성 및 자유민주적 기본질서의 수호라는 헌법적 과제를 충족하기 위한 관점에서 규범조화적으로 해석하여 양자의 충돌문제를 해결하고, 그 논의의 중심인
