한국전쟁 60주년을 맞이하여 점차 망각의 세계 속으로 빠져들어가는 한국전쟁 시기 우리가 마주하였던 법적 문제를 다시금 재조명해보고 여기서 시사점을 찾는 것은 매우 의미있는 일이다. 한국전쟁은 본래 내란에서 출발한 것이었으나, 국제평화 안전을 파괴․위협하는 것으로 간주되어 즉각 유엔이 개입함으로써 국제화된 무력충돌이었다. 특히 16개국에서 파견된 유엔군의 참전은 유엔의 성공적인 개입과 지원에 의해 대한민국을 위기에서 구출한 국제적 집단안전보장의 사례로도 꼽히고 있다. 한국전쟁은 역사가 증명하는 바와 같이 남침전쟁이요, 학살전쟁이요, 공산혁명전쟁이었다. 이 같은 전쟁을 계획․준비․개시․수행한 자들, 이 전쟁 중에 수많은 양민을 학살하고, 재산을 약탈․파괴한 자들, 그리고 무고한 사람들을 강제연행(납치)한 자들은
