[학술논문] 북한의 산업재산권제도와 남북한 산업재산권 법제통합
남북관계에서 산업재산권의 교류협력은 비정치적 분야로서 상호 교류가 가능한 분야라 할 수 있다. 남북한의 정치적, 군사적 대결구도에서 상호 이익이 되는 경제협력의 확대 길로를 찾기 위해 여러 방안들 중의 하나가 산업재산권 문제로 지적된다. 남북한이 모두 산업재산권을 상호 인정하고 상대방의 주민과 기업에게 산업재산권의 등록이나 권리행사를 허용한다면 일견 문제가 해결될 것이다. 예컨대, 소위 ‘남북한 산업재산권 또는 저작권 보호에 관한 합의서’를 채택하여 남북한이 각각 상대방 국적의 주민과 기업에게도 등록과 권리행사를 허용하면서 각각의 지적재산권을 상호 인정하는 방안을 찾을 수 있을 것이다. 본 논문은 Ⅱ에서는 북한의 산업재산권제도와 관련 법제의 주요 내용을 다루되, 여기서는 북한의 산업재산권
