[학위논문] 북한 로동당 규약과 헌법의 관계 연구

이 연구는 조선로동당 규약과 북한 헌법의 관계를 사회주의 당이론과 법이론에 비추어 법적·규범론적 관점에서 규명하려는 시도이다. 이 관계의 해석은 현상의 영역이 아닌 당위의 영역이기 때문이다. 구체적으로 이 양자를 위계의 관계, 즉 상하 규범의 관계로 볼 수 있는지를 분석하고자 한다. 기존 연구는 조선로동당의 국가 및 사회에 대한 영도원칙을 근거로, 당 규약이 헌법보다 상위 규범이라고 인식하는 경향이 있다. 당 영도원칙은 맑스-레닌으로 이어지는 사회주의 혁명이론을 현실에 적용하면서 구축된 것으로 헌법 명문화와 관계없이 사회주의를 지향하는 체제의 기본원리이다. 사회주의 국가들은 이념적으로 공산주의가 실현될 때까지 혁명의 과정에 있는 것으로 간주한다. 따라서 사회주의 혁명 이후에도 당이 혁명계급의
